1. About FOUR STRAYS MUSIC CO.

These Terms & Conditions apply to orders placed with FOUR STRAYS MUSIC CO., operated by Bettina Elisabeth Rangosch as a sole proprietorship in Switzerland (“Four Strays”, “we”, “us” or “our”).

By placing an order, you agree to these Terms & Conditions, subject to any mandatory consumer rights applicable to you.

2. What you are ordering

Four Strays creates individually personalised songs based on the stories, memories and information provided by the customer.

Our standard offer includes:

• One individually created song

• One reasonable revision round

• Individually designed digital cover artwork

• The complete song lyrics

• A translation of the lyrics where the song is written in a language different from the customer's own

All materials are delivered digitally. No physical products are included.

Each song is created specifically for the customer and is not a standard, pre-produced music product.

Our creative process may include songwriting, editing, musical direction, production, selection and the use of AI-assisted creative tools.

3. Your story and the material you provide

You are responsible for ensuring that you are entitled to provide any stories, photographs, recordings, names, texts or other materials submitted for your song.

Please do not submit material that infringes another person's copyright, privacy, personality or other rights.

You retain your rights in the original materials you provide to us.

You grant Four Strays permission to use the materials you submit to the extent reasonably necessary to create and deliver your personalised song.

4. The creative process

Creating a Four Strays song is a curated creative process.

During production, we may create, test, modify or discard different lyrics, arrangements, voices, musical ideas and versions.

These working versions form part of our internal creative process and are not included in the order.

The customer receives the version selected by Four Strays for presentation.

We don't send you every song we make. We send you the one we believe is yours.

5. Preview, feedback and revision

Before final delivery, you will receive a preview or working version of your song.

Your order includes one reasonable revision round based on your feedback.

This revision allows adjustments within the agreed song and creative concept. It does not include creating an entirely new song, changing the underlying story or developing a completely different musical direction.

After you approve the song by giving us your final “GO”, we prepare the completed digital materials for delivery.

Additional changes requested after final approval may involve additional charges. We will inform you of any proposed costs and obtain your agreement before undertaking chargeable work.

Your statutory consumer rights remain unaffected.

6. Price and payment

The price displayed at the time of ordering applies to your purchase.

Our standard personalised song is currently offered at CHF 129, subject to the price and currency displayed in the online store at checkout.

Unless otherwise stated, payment is due when the order is placed.

Payments are processed through the payment methods available in our online store.

Any applicable taxes and additional charges will be displayed during checkout where required by law.

7. Production time

Every Four Strays song is created individually, and production times may vary depending on the story, creative requirements and communication with the customer.

Any production or delivery timeframe stated on our website is an estimate unless we expressly agree to a fixed deadline.

We will communicate with customers about material delays.

8. Digital delivery

The completed song and accompanying digital materials will be delivered to the email address provided by the customer or through another agreed digital delivery method.

Customers are responsible for providing a valid email address and informing us if they experience difficulties accessing their files.

No physical shipping is included in our standard offer.

9. Cancellation and withdrawal rights

Because our songs are created individually, cancellation after creative work has begun may be subject to restrictions and applicable legal conditions.

Customers residing in the European Union may have statutory withdrawal rights, including specific rules concerning services and digital content.

Starting creative work or personalising a song does not automatically remove those rights.

Where required by applicable law, we will obtain the customer's express request or consent before beginning performance or supplying digital content during the statutory withdrawal period, together with any required acknowledgement concerning the possible loss of withdrawal rights.

Nothing in these Terms excludes or limits mandatory statutory withdrawal or consumer rights.

10. Rights to the final song

Following full payment, Four Strays grants the customer a perpetual, worldwide, non-exclusive licence to use the delivered final song for personal, private and non-commercial purposes, to the extent that Four Strays is entitled to grant those rights.

This includes personal listening, private celebrations, family events, personal gifts and sharing on personal, non-commercial social-media accounts, subject to applicable third-party platform rules.

The standard licence does not include:

• Use in commercial advertising or paid promotional campaigns

• Use in business or brand marketing

• Resale or sublicensing of the song

• Commercial distribution of the song as a standalone music product

• Licensing the song to third parties

Commercial use requires a separate written agreement and may involve additional fees.

Four Strays does not guarantee copyright ownership or exclusive rights in AI-generated or AI-assisted elements. The availability and scope of rights may depend on applicable law and the terms of the technology providers involved.

To the extent that Four Strays holds protectable rights in original human-created elements, those rights remain with Four Strays unless expressly transferred in writing.

11. Your song stays your story

We respect the personal nature of the stories entrusted to us.

We will not publish your personalised song, story, photographs, recordings or other personal material in our portfolio, website, social-media channels or advertising without your separate permission.

If you give permission for publication, you may withdraw that permission for future use by contacting us. Previously lawful publication may not always be fully reversible.

We generally retain completed digital materials in our own production storage for up to 12 months after completion of the order, and personal creative source materials and unused working versions for up to 90 days after completion.

12. AI-assisted tools and third-party services

Four Strays may use professional software, music-production tools and AI-assisted services, including Suno and OpenAI, as part of the creative process.

These technologies assist with songwriting, production, creative development and artwork.

Four Strays directs, reviews, selects and edits the creative work before presenting the song to the customer.

Third-party technology providers may impose their own technical limitations, terms and conditions.

13. Similarity and uniqueness

Every Four Strays project is individually developed for the customer.

We do not intentionally reproduce another customer's personalised song.

However, music may contain common elements such as chord progressions, rhythms, arrangements, instrumentation or stylistic characteristics.

AI-assisted technologies may also generate similar elements for different users.

We therefore cannot guarantee that every individual musical element is entirely unique, exclusive or independently protected by copyright.

14. Problems with your order

If your delivered song or digital materials are defective, incomplete, inaccessible or do not correspond to what was agreed, please contact us at team@fourstrays.com.

We will review the issue and provide an appropriate remedy in accordance with applicable law.

Nothing in these Terms limits mandatory consumer rights or statutory remedies.

15. Liability

Four Strays is liable in accordance with applicable mandatory law.

To the extent permitted by law, Four Strays is not responsible for indirect or consequential losses arising from uses beyond the agreed purposes or from third-party services outside our reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded or restricted.

16. Governing law

These Terms & Conditions are governed by Swiss law.

This choice of law does not deprive consumers residing in the European Union of mandatory protections applicable to them under relevant consumer-protection laws.

17. Changes to these Terms

We may update these Terms & Conditions from time to time.

The version applicable to an order is the version in effect when the order was placed.
